Licence Agreement (EULA)
Last updated: 2026-10-26
This agreement applies to every download, trial and purchase of Advanced Surface Tools. By installing or using the Software, or by buying a licence, you accept it.
1. Parties and scope
1.1 This agreement is between Matthias Lange, Lange Industrial Design, Vürfelser Kaule 16, 51427 Bergisch Gladbach, Germany ("we", "us") and you as the user of the Software ("you"). 1.2 It covers the SOLIDWORKS add-in Advanced Surface Tools in its Free and Pro editions, including the trial, updates and the documentation (together, the "Software"). 1.3 Downloads, payment, invoicing, VAT and refunds are processed by Gumroad, Inc. as merchant of record; Gumroad's terms apply to these. The right to use the Software is granted by us under this agreement. 1.4 Your own terms and conditions do not apply, even if we do not object to them.
2. Consumers and business customers
2.1 A "consumer" is a natural person acting for purposes outside their trade, business or profession (§ 13 BGB). A "business customer" is anyone acting in the course of their trade, business or profession (§ 14 BGB). 2.2 Where this agreement treats the two differently, it says so. Nothing in this agreement limits rights that consumers have by mandatory law.
3. Requirements
3.1 The Software is an add-in for SOLIDWORKS. It needs a licensed installation of SOLIDWORKS and a system that meets the requirements published on the product page at the time you obtain the Software (currently SOLIDWORKS 2023 or newer, Windows 10/11 64-bit, part documents). 3.2 You obtain and maintain your SOLIDWORKS licence yourself. We are not affiliated with Dassault Systèmes.
4. Licence
4.1 Free edition: we grant you a free, non-exclusive, perpetual licence to install and use the Free edition on any number of computers, for private and commercial work. 4.2 Trial: you may use the Pro functions free of charge for 14 days to evaluate them. 4.3 Pro edition: once the licence fee is paid, we grant you a non-exclusive, perpetual licence for one person, who may install and activate the Software on up to two computers. To use it on another computer, first deactivate one. A company buying for its staff needs one licence per person using the Software. 4.4 Parts, models and other results you create with the Software are yours. We claim no rights in them. 4.5 All other rights in the Software, in particular copyright, remain with us.
5. Updates
5.1 A Pro licence includes the updates we release within 12 months of purchase. After that, the installed version keeps working; newer versions require an optional renewal. 5.2 For consumers, we provide the updates required by law to keep the Software in conformity with this agreement (§ 327f BGB). 5.3 SOLIDWORKS and Windows are third-party products. We do not promise that the Software will work with versions of them released after you obtained the Software, beyond what is required by law.
6. What you may not do
6.1 You may not rent, lend, sublicense or share the Software or your licence key, or make it available to others, except as allowed in 6.3. 6.2 You may not circumvent licence checks, or decompile or reverse-engineer the Software, except where the law allows it (§§ 69d, 69e UrhG). You may not remove copyright or trademark notices. 6.3 You may transfer a Pro licence as a whole to someone else, but only if you stop using the Software, delete all your copies, and the new owner accepts this agreement. Tell us so we can move the licence.
7. Your responsibility for results
7.1 The Software creates geometry inside SOLIDWORKS from your inputs. It is a design aid. Before you use a result for manufacturing, tooling, moulds or a product, you must check it yourself (dimensions, wall thickness, strength, manufacturability, fit). 7.2 The Software is not designed, tested or certified for applications where an error could cause injury or major damage (for example medical devices, aircraft, safety-relevant vehicle parts, or load-bearing parts). Do not rely on it there without your own independent verification. 7.3 Save your work before using a tool and keep regular backups appropriate to the value of your data. CAD software and add-ins can stop unexpectedly. 7.4 This clause describes the intended use and your duties of care. It does not limit our liability under clause 9.1.
8. Defects
8.1 Free edition and trial: these are provided free of charge. We are only responsible for defects if we fraudulently concealed them, and as set out in clause 9. 8.2 Pro edition: the Software has the features described in the documentation at the time of purchase, including the known limits listed there. Software of this kind cannot be made error-free for every possible part, geometry and setting. Statements in advertising are not a guarantee of particular properties. 8.3 Business customers: report defects by email with a description of the problem, and the log file where possible. We fix the defect by an update, a correction or a reasonable workaround, at our choice. If the fix fails, you may reduce the price or withdraw from the contract. Claims for defects expire 12 months after you received the Software, except for claims under clause 9.1. Damages are governed by clause 9 only. 8.4 Consumers: your statutory rights for digital products (§§ 327 ff. BGB) apply.
9. Liability
9.1 We are liable without limitation for intent and gross negligence, for injury to life, body or health, under the Product Liability Act (Produkthaftungsgesetz), for fraudulently concealed defects, and where we have given an express guarantee. 9.2 For slight negligence, we are only liable if we breach an essential contractual obligation: one whose fulfilment makes proper performance of the contract possible in the first place and on which you may regularly rely. In that case, our liability is limited to the damage that was typical and foreseeable when the contract was made. 9.3 Business customers: in the cases of 9.2, and to the extent the law allows, our total liability is limited to the licence fee you paid. We are not liable for indirect damage, lost profit or production downtime caused by slight negligence. 9.4 Loss of data: where we are liable for loss of data, our liability is limited to the effort needed to restore the data from backups made regularly and appropriate to the risk (see 7.3). 9.5 Free edition and trial: as these are free, we are only liable for intent and gross negligence, and as set out in 9.1. 9.6 Except as set out in this clause 9, our liability is excluded. These limits also apply to the personal liability of our employees, representatives and agents.
10. Term and termination
10.1 The licence has no time limit. It ends if a purchase is refunded or charged back. 10.2 Either party may terminate for good cause. Good cause for us is in particular a serious breach of clause 6 (for example sharing or selling licence keys) that you do not stop after a warning. When the licence ends, you must stop using the Pro edition and delete it.
11. Data protection
The Software sends no data. Details are in our privacy policy at swplugins.com/legal/privacy.
12. Changes
The version of this agreement that you accepted when you obtained the Software applies. Newer versions apply to a later version of the Software only if you accept them when you install that version.
13. Governing law and venue
13.1 German law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). If you are a consumer, you keep the protection of the mandatory law of the country where you habitually reside. 13.2 If you are a merchant (Kaufmann), a legal entity under public law or a special fund under public law, the exclusive place of jurisdiction is Bergisch Gladbach, Germany. We may also sue you at your general place of jurisdiction.
14. Final provisions
14.1 If a provision of this agreement is invalid, the rest remains valid. The statutory provisions apply in place of the invalid one. 14.2 This agreement is concluded in English. It is available at any time at swplugins.com/legal/eula.
